Woman Obtains Student Loan Discharge of over $250,000

She Had Owed More than $400,000 By Nancy Hull Rigdon, Special to Missouri Lawyers Weekly A 50-year-old woman who owed more than $400,000 in student loans settled the debt for $150,000, with the possibility of getting out for less with consistent monthly payments. This debt was destroying her life and her ability to function, and that is what bankruptcy is for, said attorney Neil Sader, who represented the woman in her suit against Suntrust Bank and Educational Credit Management Corp. The parties agreed to discharge the debt for either $150,000 or $78,607 if she pays $750 per month for up to 10 years, according to a U.S. Bankruptcy Court for the Western District of Missouri order of judgment from Judge Cynthia Norton. It’s hard not to notice that customer service has rapidly declined in America over the years. Take, for example, the fact that many companies have gone to automated phone systems where a person can’t talk to a live human being, even when repeatedly pressing 0. In the legal industry, specifically with respect to bankruptcies, many firms use the attorneys to “sell the firm,” sign the paperwork, and make court appearances. They use legal assistants and paralegals to field phone calls, respond to emails, and keep current clients from taking up the attorneys’ time, so the attorneys can focus on getting more clients to sign up with the firm.
